Conditions for permit exemption

According to the court rulings compiled by Hukuki Haber, the criteria are: not forming a building within the meaning of the Zoning Law (İmar Kanunu), not creating an enclosed volume, being open and for shade only, using lightweight material, not changing the facade and not impairing the load-bearing system. Article 59 of the Planned Areas Zoning Regulation lists structures such as pergolas and gazebos among those not subject to a permit.

There is no fixed list of materials; the Council of State (Danıştay) has accepted timber, steel profile, polycarbonate and in some cases a tiled roof. There is a ruling that a lean-to canopy surrounded by folding glass did not count as an enclosed volume; structures that are closed in, such as a winter garden, and gazebos with concrete and walls have been found subject to a permit.

In multi-storey buildings and common areas

In the common areas of multi-storey buildings, permit and condominium procedures are required for pergolas. For detached gardens, a pergola has generally been accepted as permit-free. There is also a ruling in which a permit was required for a pergola built on the roof of a registered building.

Floor-area ratio and the 2026 amendments

The amendment of 1 July 2026 (Official Gazette 33297) provides that pergolas and ornamental pools in the regulation will not be counted in the floor-area ratio if they are garden landscaping in nature, have no independent unit or annex, are not integrated with the main load-bearing system, and together with other garden uses do not exceed 20 percent of the garden area. The same amendment defines an ornamental pool as a pool not used for swimming; swimming pools fall outside this exception.

The amendment of 14 January 2026 (Official Gazette 33137), under certain conditions, takes carport canopies and windbreak lobbies of 7 m² and under out of the permit requirement. The texts we read are republished versions, not the Official Gazette issue; verify the current text before applying.

Setback distance

The definition of a lean-to canopy includes a condition of not violating the building setback distance; the text we read has no such wording in the pergola definition.
